Welcome to the Terms of Use (including any future modifications, the “Terms”) for this website and online services which include these Terms or a link to these Terms (including all Content therein, the “Zelda216 Media Photography”). The Zelda216 Media Photography are made available to you by Zelda216 Media Photography, a Ohio sole proprietorship, its affiliated companies (including successors assigns, “Zelda216 Media Photography,”  “I,” “we,” “us,” or “our”). These Terms set out the agreement between us and you regarding how you can use the Zelda216 Media Photography and what responsibilities you and we have to each other. PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THE ZELDA216 MEDIA PHOTOGRAPHY. THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS INCLUDING MANDATORY ARBITRATION, NO CLASS RELIEF AND WAIVER OF YOUR RIGHT TO A JURY TRIAL. By accessing or using any of the Zelda216 Media Photography you agree to these Terms. If you do not agree to these Terms, please do not access or use the Zelda216 Media Photography.

A.  Copyright

Bonita Elias owns all copyrights, interests and other rights to the photographs taken by Bonita and other photographers for Zelda216 Media Photography. Ohio state and federal copyright laws give Zelda216 Media Photography the exclusive rights to the photographs, including but not limited to the right to sell, print, copy, edit, display and distribute the images. These exclusive rights make it illegal for you to copy, scan, edit, publish or share photographic images and digital media without Zelda216 Media Photography's permission.

Sale or use of the photographs taken by Zelda216 Media Photography for profit is strictly prohibited. Use of the photographs in films or videos is also not allowed.

B.  Individual Sessions

Unless it’s a group package being purchased, session packages are for individuals only and are not to be shared

 

C. Location Costs & Fees

You are responsible for any applicable costs and/or permit fees associated with the location chosen for a session that is not held at my studio. I will not guarantee or arrange payment at any location. You must choose a location that is no more then a thirty-mile drive from my studio address. Any location outside of these limits will be an additional charge of $.50 / mile as part of the agreement.

 

D.  Re-shoot Policy

Throughout your session I may show you the back of the camera so you can see your images in process. If you want to make a change (i.e. backdrop, posing, hair, wardrobe), you must state your requests during your session. Re-shoots and refunds will not be given for poor choices of clothing, or by personal choice with hair & makeup, weather-related issues, or by not following my recommendations.

E.  Ordering /Archiving

Proofs from individual sessions will be delivered in 2-4 business days. No Proof galleries will be online and available for viewing for 14 days from the time of the session. Only in person reveals.  You are expected to place your orders within that 14-day period. Please place your order within that time frame. The gallery will be deleted after 14 days and clients who have not placed an order will need to pay a fee of $125 for the gallery to be reposted. Please see

F. Copyright & Penalty

All images appearing on the Zelda216 Media Photography web site, unless noted otherwise, are the exclusive property of me and are protected under the United States and International Copyright laws. The images may not be reproduced, copied transmitted or manipulated without my written consent.

Ohio state and federal copyright laws give me the exclusive rights to the photographs, including but not limited to the right to sell, print, copy, edit, display and distribute the images. These exclusive rights make it illegal for clients to copy, scan, edit, publish or share photographic images and digital media without my permission.

Sale or use of the portraits taken by me for profit is strictly prohibited. Use of the photographs in films or videos is also not allowed. I reserve all rights including the right to refuse service to anyone who disregards copyright laws. Thank you for respecting me, and my profession.

G.  Liability

Zelda216 Media Photography is not responsible for any injuries inflicted upon any participating parties during a session.

H.  Session Requests

No cameras / video cameras / any type of recording device (this includes cell phone cameras) are allowed during the session unless prior arrangement has been made between clients and I, including a written agreement. The session starts at the agreed upon time. If a client is more then 20 minutes late to a session, it will need to be rescheduled.
